a. Family KITAS

A Family KITAS (Kartu Izin Tinggal Terbatas) in Indonesia is a residency permit that allows foreign nationals to live in the country with their family members. KITAS is a crucial document for those who plan to reside in Indonesia for an extended period, whether for work, business, or other purposes. Here’s an explanation specifically focusing on the Family KITAS:

Eligibility:

Foreign nationals eligible for a Family KITAS are typically sponsored by a spouse or parent. But remember, you can’t earn money in Indonesia unless you have a valid work permit (IMTA) or are involved in legal business activities.

Application Process:

The process usually starts with the primary visa holder applying for their respective visa (e.g. E.Visa). Once the primary visa is secured, the family members can apply for the Family KITAS.

Required Documents:

For a KITAS sponsored by an Indonesian spouse/parent:
  • Certificate showing an account balance of at least $2,000 (in the sponsor’s account).
  • Passport.
  • Spouse Family Card (Kartu Keluarga).
  • Marriage certificate.
  • Domicile in Bali from both spouses.

Duration:

The KITAS is valid for 5 years, with a mandatory renewal periodically.

How To Apply:

To complete the application process, follow these two stages:

  1. Apply for the Visit Visa (Social or Business type). Then enter Indonesia.
  2. Submit an online application at izintinggal-online.imigrasi.go.id and follow the steps provided.
    • Once submitted, you will receive an email notification instructing you to visit the nearest Immigration office for biometrics, a photo session, an interview, and payment of PNBP (Non-Tax State Revenue).
    • After successful completion of these steps, if everything is in order, the KITAS will be sent to you via email in PDF format.

Many expatriates seek the assistance of immigration agents or services to navigate the complex process of obtaining and renewing Family KITAS. These agents can help ensure that all documentation is in order and the process is smooth.

b. Employment KITAS

The Employment KITAS is issued to foreign nationals who have secured employment in Indonesia. It allows tyou to legally live and work in the country for a specified duration.

Eligibility:

A foreign national must be sponsored by an Indonesian employer or company. The employer plays a crucial role in facilitating the application process and acting as the sponsor for the employee.

Application Process:

The application for an Employment KITAS is typically initiated by the sponsoring employer. The employer must submit the necessary documents to the Indonesian immigration authorities on behalf of the foreign employee.

Required Documents:

The specific documents required may vary, but common requirements include:
  • A valid passport
  • A formal employment contract
  • A sponsorship letter from the employer
  • Health insurance
  • Other supporting documents.

Duration:

The KITAS is valid usually for the duration of the employment contract. It may be issued for one year and can be renewed as long as the employment relationship remains valid.

How To Apply:

  • The process begins with the employer in Indonesia. The employer serves as the sponsor for the foreign employee, initiating and facilitating the application process to the local immigration office in Indonesia or online to  izintinggal-online.imigrasi.go.id.
  • Upon successful document verification, the immigration office will issue a Telex Visa approval. This approval is then sent to the Indonesian embassy or consulate in the employee’s home country.
  • The foreign employee applies for an Indonesian visa at the Indonesian embassy or consulate in their home country, presenting the Telex Visa approval and other required documents.
  • Once the visa is granted, the employee travels to Indonesia. Upon arrival, they need to report to the local immigration office within seven days.
  • Following the necessary checks and approvals, the Indonesian immigration authorities issue the Employment KITAS. This permit allows the foreign employee to legally reside and work in Indonesia.

Family or Dependent KITAS (Optional):

If the employee wishes to bring family members or dependents, a separate process for Family or Dependent KITAS may be required.

c. Investor KITAS

The Investor KITAS is designed for foreign nationals who plan to invest and actively participate in business activities in Indonesia. Either you invest in an existing company or create your own company entity.

Eligibility:

  • To get an Investor KITAS in Indonesia, you must find a local sponsor, like a business or an investment agency, to help with the application. Keep in mind that if you’re applying for an Investor KITAS for an existing Indonesian business entity, you’ll need to show that you have shareholders with at least 1.125 billion IDR. This proof is crucial for a successful application.
  • Another option is to establish a business entity in Indonesia, such as a limited liability company (PT) or a foreign investment company (PMA). The type of entity may depend on the nature of the investment and the investor’s goals. Keep in mind to establish your own PT PMA, you have to prove an initial investment of a minimum of 10 billion IDR (that could be shared with some other shareholders)

Application Process:

  • The next step is to submit the investment application to the Investment Coordinating Board (BKPM). This board is responsible for regulating and facilitating foreign investments in Indonesia.
  • Once your investment application is approved by BKPM, you will receive an Investment Approval (Izin Penanaman Modal or “Izin Principle”). This approval is a prerequisite for obtaining the Investor KITAS.
  • With the Investment Approval in hand, you can proceed to apply for the Investor KITAS at the immigration office. The local sponsor (would be your business relative you invest to an existing business entity and would be your HR manager or Operational role as your sponsor for the application process if you own your PT PMA) will assist in preparing the required documents.

Required Documents:

The specific documents required may vary, but common requirements include:
  • A valid passport
  • Investment approval
  • A sponsorship letter
  • Health insurance
  • Other supporting documents.

Duration:

The investor KITAS is valid usually for 5 years and mandatory to renewal periodically.

How To Apply:

  • The process begins with the sponsor in Indonesia initiating and facilitating the application process to the local immigration office in Indonesia or online to  izintinggal-online.imigrasi.go.id.
  • Upon successful document verification, the immigration office will issue a Telex Visa approval. This approval is then sent to the Indonesian embassy or consulate in your home country or other country where you would like to pick it up.
  • You will apply for an Indonesian visa (VITAS) at the Indonesian embassy or consulate in your home country, presenting the Telex Visa approval and other required documents.
  • Once the visa is granted, you can enter Indonesia. Upon arrival, you will need to report to the local immigration office within seven days.
  • Following the necessary checks and approvals, the Indonesian immigration authorities issue the Investor KITAS.

Family or Dependent KITAS (Optional):

If the employee wishes to bring family members or dependents, a separate process for Investor or Dependent KITAS may be required.

Additional Information:

Even if you have a valid Investor KITAS and own shares in the company, it doesn’t automatically allow you to work and get a salary in Indonesia. Typically, you might take on a role like commissioner or director within the company.

As a shareholder, you can receive a share of the profits, known as a pro-rata dividend. Keep in mind that these dividends are subject to a 10% tax in Indonesia.

If you want to work for your company, you’ll need to go through the proper hiring process, obtain a “Work Permit,” receive a salary, pay taxes on that salary (income tax), and contribute USD 1,200 annually for DPK-TKA (Compensation to Hire Foreign Workers). This ensures compliance with Indonesian regulations regarding foreign workers.

d. Retirements KITAS

The Retirement KITAS (Kartu Izin Tinggal Terbatas) in Indonesia is designed for foreign nationals who wish to retire and live in the country. The process involves specific requirements and steps. Here’s a general guide on how to process a Retirement KITAS in Indonesia:

Eligibility:

To qualify for a Retirement KITAS, applicants typically need to be at least 55 years old and show proof of sufficient financial capability to support themselves during their stay in Indonesia.

Application Process:

Retirees usually need a sponsor to facilitate their application. This sponsor can be an Indonesian citizen or a legal entity. The sponsor is responsible for submitting the application on behalf of the retiree.
